Torrentspy have been ordered to start tracking what their users are getting via their tracker site. This is despite their privicy rules promising that they won't.

They are appealing this, but it is better to tell anyone you know who might be doing norty things that they should stop using this site.

You have not heard about the same sort of thing going on with the British music industry, then ? There's probably no reason why they might not go down the same road, if not with that site then others that work the same way. It's still worth knowing, and being aware of if you use their site.

im on a private torrent site so it dont bother me lol the film/music industrys hate it,they overpriced there cds years ago fuck em

That doesn't stop the law seizing their servers at some point. Nothing is 100% private on the interwebs at some point all traffic passes through something that can be monitored. It's only a question of whether it's too much hassle or not.

they'ed have 1 hell of job taken all us illegal downloaders to court,they tried that shite with the pirate bay erm 3 days later it was back online lol

its just scare tactics the bpi flood the charts with so much shit music anyway they should be taken to court lol

Hahaha, that's very true, although it's the record companies that are flooding the market. They're all going down the pan fairly rapidly and losing money - unfortunately crap music sells these days, as such the record companies are putting more and more crap out. Very few lable's are interested in putting decent stuff out; especially music that advances the art a bit and is genuinly fresh. It's all part of a vicious cycle.

The way Britain and American are at the moment, I wouldn't be supprised if our record industry follows suit or the government submit if the US authorites put out extradition orders. So I advise that anybody using torrent trackers be at least vigilant about their use, although private trackers tend to be safe. And the chances are that the IFPI will get involved over here some time in the next few years anyway.

Legal precidents for P2P haven't been set here yet, however; in Spain there has been a case which ruled downloading music (presumably this will apply to films too) for free from the net isn't illegal so long as the content is for personal use, or the user isn't profiting from it. With Britian being part of the EU, it's quite likely that we will see a similar ruling at some point.

This is *exactly* what they want people to do.

The issue here is that TorrentSpy does not currently log or record any of the information that the court order demands. The order is not telling them to turn over log files, but to make them purely for the purposes of the recording industry. For this reason, they have been granted a stay and do not have to do this. If the final judgement goes against them then they will move the servers out of the US so they are no longer under the jurisdiction of the US courts and they cannot demand that they record this information.

Oh and private tracker sites aren't any more secure. Think Elite Torrents. It was a good half day between the servers being seized and then all the ops scarpering from the IRC channel when they realised what happened. Whatever the site, there will be data collectors who pass information on unless it is a very tight community where everyone knows exactly who everyone is.
