Does anyone know my rights??

I bought my laptop in february, one of the keys has come off and im really annoyed about it.... they say they will send it off for repair and i say no, i want a new one as i didnt spend all that money less that 3 months ago for it to break and be repaired!! They say that is their policy!

Any advice will be appreciated!

No chance...I once had a laptop repaired 3 times in a year.....you only have the right to have it repaired while it is still under guarantee...sometimes you get a replacement in the meantime.

So never buy a laptop without reading tests before.....Sony and Toshba are quite good. Which one do you have?

Completely a long shot, but I know that some makers of desktops tried out the idea of shipping the part to the customer and allowing them to fit it themselves. I don't know if that still happens, though.

Considering keyboards, to my knowledge, are quite easy to replace it might be worth trying to get them to ship the part if you know someone who'd be happy to fit it for you.

Otherwise, wishing you good luck :s is the best I can offer you. I'm fortunate to have 2 desktop computers & 1 laptop.

I think with most things elecrical that nearly all firms will repair rather than replace purley for costing reasons.
The only time they replace stuff is if its well and truley knackered u know Sad
as long as u have it repaired by the company u bought it off so as not to invalidate the guarantee.

Sorry Tinker, but in most cases the small print reads that repair or replacement is at the manufacturers discretion, so if thats what they say they will do,then thats it.

Take a careful read though, because with a lot of new or current items, if the new parts are not readily available it can lead to a wait for repair.

Most guarantees have a "If it cannot be repaired within ?? days, you are entitled to a new, replacement item"

For obvious reasons most manufacturers seem to try and forget/ignore/gloss over this section!!!

If the problem persists, and the key(s) keep falling off, then I would suggest a letter to the manufacturer (with c/copies to the retailer and trading standards) stating that the machine is "not fit for purpose" and requesting a full refund.

Good luck......

I think that is probably a very good point! It's been so long since I had to return things that my brain has gone to sleep about some aspects of consumer rights.

If the matter hadn't been complicated by moving so far away from the shop I bought a cheap digi cam from, then I'd have tried to argue that. I had it repaired once and then it broke again soon after. It's now cheaper to just buy a new one of a similar value, in my case, which is a shame.

All the keys on a keyboard that I have seen clip back into place in some way unless the clip is actually broken, with a spring of some sort around the thing that clips the key into the keyboard. I've not yet come across any that require a special device of any sort, that'd be new to me.

Be a little bit careful there Tinker - any "home made" repairs may well invalidate this and any future guarantee claims - not a great loss for the sake of a key you may think, but when your hard-drive jams with a week left on the warranty.........

Aaaah...hold on a minute! - Know your rights, according to the Sale of Goods act 1979 and subsequent amendments in '82, '94, and '02 it would seem that you have the advantage (the law generally goes in favour of the customer anyway)...
"...the repair or replacement must be carried out within a reasonable time and without causing significant inconvenience to the consumer."
I advise you read the whole of the Act as it contains a lot of very useful information (I have) and it's only about 3 or 4 pages, also there are links to 'Trading Standards' etc all at the official website for the Department of Trade and Industry...

I think armed with that you'll get it sorted more quickly - I read somewhere that in the eyes of the law 'significant inconvenience' is determined by YOU, not the seller Smile
